Abstract

The digital transformation in the practice of treaty law in Indonesia has encouraged the use of electronic deeds as an alternative to conventional documents. Despite offering efficiency and convenience, the implementation of electronic deeds still faces various legal challenges, especially related to the issue of system security and legal recognition of its validity and evidentiary strength. This article aims to analyze the legal challenges in the use of electronic deeds, focusing on aspects of data protection, reliability of electronic systems, and the legitimacy of electronic signatures in a positive Indonesian legal perspective. This study uses a normative juridical approach by examining laws and regulations, legal doctrines, and practices that develop in society. The results of the study show that although normatively electronic deeds have been recognized, there are still gaps in implementation, especially related to security standards, data leak risks, and suboptimal regulatory harmonization. Therefore, it is necessary to strengthen the legal framework and increase digital legal awareness to ensure certainty and legal protection for parties.
